Direction 123

Section 499 of the Migration Act 1958 gives the Minister the power to give written directions to a person or body having functions under the Act. This includes public servants holding delegations to excercise the Minister's powers under the Act as well as the Administrative Review Tribunal reviewing the exercise of those powers. The person or body must comply with the directions unless they are inconsistent with the Act or the Regulations.

With effect from 31 October 2026 the Minister has made Direction 123 relating to decisions about visa refusals and cancellations under section 501 and revocations of mandatory cancellations under section 501CA.
