Direction 110

Section 499 of the Migration Act 1958 gives the Minister the power to give written directions to a person or body having functions under the Act. This includes public servants holding delegations to excercise the Minister's powers under the Act as well as the Administrative Appeals Tribunal reviewing the exercise of those powers. The person or body must comply with the directions unless they are inconsistent with the Act or the Regulations.

With effect from 21 June 2024 the Minister has made Direction 110 relating to decisions about visa refusals and cancellations under section 501 and revocations of mandatory cancellations under section 501CA.
